By creating an account or using EngineFlux.io ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. You represent that you have the legal capacity to enter into a binding agreement and that you have read, understood, and accept these Terms in their entirety.
2. Description of Service
EngineFlux.io provides a delivery control room application for software teams, including ticket tracking, delivery metrics, analytics, and related features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
3. Account Registration and Security
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service: (a) in any way that violates applicable laws or regulations; (b) to transmit any harmful, offensive, or illegal content; (c) to attempt to gain unauthorized access to the Service, other accounts, or computer systems; (d) to interfere with or disrupt the Service or servers; or (e) to use the Service for any purpose that is fraudulent or otherwise prohibited.
5. Fees and Payment
Certain features of the Service may require payment. By subscribing to a paid plan, you agree to pay all applicable fees. Fees are non-refundable except as required by law or as explicitly stated in our refund policy. We may change our fees upon reasonable notice.
6. Intellectual Property
The Service and its original content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from the Service without our prior written consent. You retain ownership of any data you submit to the Service; however, you grant us a license to use, process, and store such data as necessary to provide the Service.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify, defend, and hold harmless EngineFlux.io and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content or data you submit to the Service.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may terminate your account at any time. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive, including intellectual property, disclaimers, limitation of liability, and indemnification.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, the dispute shall be resolved through binding arbitration or in the courts of competent jurisdiction, as permitted by applicable law.
12. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.
